General Conditions of Sale (GTC) – Sales Terms
OVERVIEW
The author of the of the Product Sales Offerings and content of the “Site” www.frenchvintagetresor.com is operated by the French company CREATIVE TRESOR “Société”, a simplified joint stock company, under the registered commercial name FRENCH VINTAGE TRÉSOR. Throughout the Site, the terms "I", “me” and “my” refer to FRENCH VINTAGE TRÉSOR. For purposes of these General Conditions of Sale “General Conditions”, "you" and "your" means you as the user of the Services, whether you are a customer, Site visitor, another individual or professional business. I offer this Site (refer below), including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
The Site is part of a larger e-commerce service platform provided and owned by SHOPIFY Inc. “Third-Party Service Provider” which allows me as a registered “SHOPIFY User” to use their “Online Services” to sell my Products and/or services (where applicable) to my Customer(s). Online Services are defined as tools to unify commerce activities, build and customize online stores, manage Products, inventory, cross selling through sales channels as well as payment processing, hosting data and domain services. As such, the Online Services offered by them and described herein are subject to their Terms of Services as an additional safeguard for my Customer(s). By visiting my Site and/ or purchasing something from me, you engage in my “Service” and agree to be bound by the following terms and conditions (“General Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these General Conditions & Terms carefully before accessing or using my Site. By accessing or using any part of the Site, you agree to be bound by these General Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any Services. If these General Conditions are considered an offer, acceptance is expressly limited to these General Conditions & Terms.
Any new features or tools which are added to the current store shall also be subject to these General Conditions & Terms. You can review the most current version of the General Conditions at any time on this page. I reserve the right to update, change or replace any part of these General Conditions by posting updates and/or changes to our Site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.
Section 1: ONLINE STORE TERMS
The General Conditions apply to all sales of Products or Services (if applicable) made through the Site. The sale of the Products or Services are covered by these General Conditions is reserved exclusively for you the consumer whether private individual or professionals (any natural or legal person) and aged over 18 years wishing to a purchase a Product(s) through the Site www.frenchvintagetresor.com.
Again, by visiting the Site and/or purchasing one of the Products or Service, you engage in a Sales Contract with me and agree to be bound by the General Conditions (i.e., declare you have reached the age of 18 years), including those additional terms, conditions and policies referenced herein and/or accessible by hyperlink. The order form and the order confirmation constitute the Sales Contract between us relating to the sale of the Products ordered. Any order placed on the Site requires that you accept in advance and without reservation the General Conditions in their entirety. In the event of disagreement with the terms and conditions of the General Conditions, you must NOT use the Site. Each purchase on the Site is governed by the General Conditions applicable as of the date of the order. By validating your order, you unreservedly accept the General Conditions confirming you have read and agree with them. Your Sales Contract executed will be archived by me for the retention period prescribed by applicable laws.
I reserve the right to adapt or modify these General Conditions at any time and without notice, the adaptations or modifications then being applicable to all orders subsequent to these adaptations or modifications. In the event of modification, the General Conditions applicable to your order are those which were online on the day of placing your Order.
The language in which a Sales Contract can be concluded through this Site is the English language. There may be language translations offered by the Third-Party Service Provider but the translations are ONLY provided for convenience and they are NOT legally binding. I do not review the accuracy of these translations provided and they should not be relied upon by you as part of the Sales Contract.
Section 2: PRODUCT INFORMATION & AVAILABLITY
The Site makes available information about the Products or Services (if applicable) and applicable prices. The Products or Services are offered for sale Worldwide depending on the availability of the markets (countries) serviced by the Third-Party Service Provider.
I reserve the right, but have no obligation, to limit the sales of Products or Services to any person in any geographic region or jurisdiction and may exercise this right on a case-by-case basis. I may also modify the selections of Products or Services and limit the quantities and types of any Product or Services offered from my Site. All Product or Service descriptions and pricing are subject to change at any time without notice, at the sole discretion of me. I also reserve the right to stop offering a Product or Service at any time and if a Product or Service is prohibited by law, it can be made void by the Site. I offer Products until the stock is exhausted and the Product catalog will constantly evolve and change.
During the purchase process, I will inform you as soon as possible if the order cannot be processed due to the unavailability of the Product or Services ordered. I am not responsible to you for the unavailability of the Product or Service before the conclusion of the Sale Contract. I can cancel the order (Sales Contract) and you will be reimbursed no later than fourteen (14) days following the date the sale as determined to be unavailable, unless you wish to select an alternative Product that is similar in quality and price to replace the original Product ordered.
Each Product or Service is accompanied by the most precise description possible. I strive to present, as clearly as possible, on the Product or Service listing descriptions available on the Site, the main characteristics of the Products or Service and the mandatory information under applicable legislation. Unless expressly indicated otherwise on the Site, all Products or Services are sold by me are used (second-hand) and may therefore present imperfections due to their age and/or previous use. All items are of vintage quality and will show some signs of age and were manufactured at a time when processes were less sophisticated and not machine operated. Therefore, in addition to the defects identified and reported in the Product or Service listings descriptions, there could be slight dimensional and weight differences or deviations in the color and small manufacturing imperfections could be observed.
The photographs, which are the exclusive property of me are as faithful as possible but cannot ensure perfect similarity with the Product presented, in particular with the colors and materials. The photographs are used for illustrative purposes only within the limits of technique and the best market standards. The photographs have no contractual value. If errors are introduced, under no circumstances can I be held responsible. Please note that the Products or Services offered are old, so they contain traces of time, scratches, chips or defects due to their age.
Certain products or services may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only according with Section 7: RIGHT OF WITHDRAWAL & RETURN POLICY.
Furthermore, under no circumstance, can I be held responsible for errors occurring following a failure of your connection to the Site.
Section 3: PRICE
The prices on the Products are indicated in EUROS including tax (TTC), unless otherwise indicated. They do not include processing fees (if applicable) or delivery shipping costs, which are calculated separately based on your final shopping cart weight, dimensions, address and delivery method. All orders regardless of origin are payable in EUROS and the Third-Party Service Provider processing the payment will translate with their exchange rate, the amount due in your local currency if not EUROS upon checkout.
I reserve the right at any time to modify the prices without notice however the Product will be invoiced on the basis of price in force at the time of validation of order subject to availability unless there was an obvious error in price. In this case, I reserve the right to cancel the order and your payment will be immediately refunded.
I carry out regular checks regarding the accuracy of the prices of the Products appearing on the Site; however, I cannot guarantee that the Site is error free. In the event that an error in price is detected, I will refuse the order and offer you the opportunity to purchase the Product at the correct price. If the error is detected after the order has been accepted, you can cancel the order and will be immediately refunded.
For orders placed outside of the European Union, in the event that Customs and Duties may be payable to local authorities, you are responsible for any customs and import taxes that may apply. Furthermore, I am not responsible for delays due to customs.
Section 4: EXECUTION OF THE CONTRACT
The essential characteristics and price of each Product are displayed on the Site. The information displayed on the Site does not in any way represent an offer by me.
Before placing an order through the Site, you must carefully read all the instructions communicated to you during the purchasing procedure (also with regard to possible delivery costs, the conditions of the right of withdrawal, the policy on the protection of personal data – Refer to LINK), as well as these General Conditions. Upon acceptances, you must create a user account in order to purchase Products. Upon creation of the user account, in order to purchase Product(s) you must; (i) include the selected Products in the shopping cart by clicking on the corresponding button, (ii) complete the order proposal, (iii) choose the payment method, (iv) accept the General Conditions and (v) transmit the order proposal to me through the Site
Sending the order constitutes a purchase proposal for the selected Products, subject to these General Conditions and is binding with you, subject to the right of withdrawal provided for in Section 7. Sending the order proposal by you entails the obligation for the latter to pay the price of the Products ordered.
The contract between us is concluded upon receipt, by you, of my acceptance of the order proposal (“Order Confirmation”). Acceptance (or refusal) by the me must be communicated to you by email to the address provided by the latter in the order proposal.
I may refuse any order proposal within 30 days of receipt of said proposal. In this case, no compensation will be owed to you by me. I may refuse in the following cases (by way of non-limiting examples): (i) The Products are not available (subject to the provisions set out in Section 3.3); or (ii) Activities are reported or suspected to be illicit or fraudulent, including purchases suspected to be made for commercial purposes; or (iii) The Customer has not fulfilled its obligations arising from a previous contract executed with Your company.
In the event of unavailability of one or more of the Products, you will receive an email informing you, as required, of the unavailability of the Products. In such a case, the order proposal will be canceled or partially accepted only for the Products available. In the event of partial acceptance, you must pay (or be charged, if paying by credit card) only the price of the Products available.
The risks of loss or damage relating to the Products are transferred to you when you (or a third party indicated by the you and other than the Shipping Carrier) have acquired physical possession of the Product.
Section 5: PAYMENT METHODS
Payment of the price of the Products included in the order proposal, as well as applicable taxes and delivery costs, if applicable, must be paid by you by Payment Method. Payment is due in full upon Order Confirmation unless another payment arrangement is agreed between us prior to the Order Confirmation.
I accept credit cards & PayPal: Visa, Mastercard, American Express, Apple Pay using the secure SHOPIFY, Inc. Payments System. All SHOPIFY Payments transactions are subject to the SHOPIFY Payment Privacy Policies at the link below.

Transactions will be charged to your credit card only after: (i) the credit card details have been verified; (ii) authorization to charge the card will have been received from the issuer of the card used by you; and (iii) availability of the Products will have been confirmed by me.
For each order, I must send you an invoice for the Products by email, in accordance with the applicable law or regulation. The invoice will be established according to the information provided by you at the time of the order.
Section 6: SHIPPING & DELIVERY
All orders are shipped by me from FRANCE (country-of-origin of Products) and I ship Worldwide depending on the availability of the Shipping Carrier Service (“Shipping Carrier”). All shipping & handling fees are paid by you and will be included in the Order Confirmation.
I am happy to consolidate shipments of multiple orders up to 20 kilos to help reduce shipping fees, where possible depending on the size of the combined items. The shopping cart may NOT always reflect the consolidated price due to configuration limitations so PLEASE ask me if the shipping costs look inaccurate based on the Tariff (fee) schedule outlined herein. I can create manual order invoice to correct any issues with the system upon request.
Processing & Delivery Times:
1st Processing Times: In general, I process orders (Order Fulfilment) once a week on weekdays (working days and not on French Holidays). The Processing times depend on the timing of the order placed, availability of the Product(s) ordered at the offsite storage facility and supplies of packaging materials and the amount of time needed to carefully package the order. My Processing time estimate is based on the longest estimate time of 7-10 business days following the date indicated on the Order Confirmation. This gives the most realistic expectation of receiving the order. Please note: It may be possible to process orders more quickly so please contact me as soon as possible if you order is time-sensitive to confirm I can accommodate the shorter Processing time.
2nd Delivery Times: The delivery time is measured from the Order Fulfilment date (date the order “package” is handed over to the Shipping Carrier) and the date of the first attempt of delivery to the address provided with the order. This is also the date of Transfer of Ownership/Risk. Refer to Section 7.

Shipping Carriers & Tariffs
All international deliveries require a signature on delivery. All Shipping Carriers have different service contract requirements so it’s important that you understand each one differently when selecting the Shipping Method at checkout. The most reliable option in my opinion is Colissimo and this is the one selected most frequently.
NEW USA GLOBAL TARIFFS - I SHIP to the USA with DHL Express as Delivered Duties Unpaid (DDU) rather than Delivered Duties Paid (DDP) to avoid additional costs and processing fees. You will be contacted at the US border to pay the customs and duties directly online with your DHL waybill reference. Tariff estimations can be provided toyou upon request but will not be more than 15% of the product price. I can ship DDP at your request but at an additional costs and fees.
I am not responsible for paying customs and duties imposed at the border.
DHL EXPRESS - to be updated with DHL Express for USA Clients for New Global Tariff processing and rules.
La Poste (French Postal Service): This service is rarely used (less than 5% of orders) as it’s for letters or small packages ONLY that are less than 3 cm thick, 3 kg maximum and dimensions: MIN: 14 cm x 9 cm & MAX: Length + Width + Height = 100 cm with the length less than 60 cm. Tariffs can be provided upon request.
Colissimo (La Poste Parcel & International service) Home Delivery: This service is most often used as it’s for larger packages and have a good international network with local Shipping Carriers. They provide tracking, minimum insurance (refer below) and estimated delivery dates.
They deliver packages up to 20 kg (post COVID changed from 30 kg to 20 kg). The sum of the length, width or height CANNOT exceed 1.50 meters and the length less than 1 meter. If the dimensions exceed these amounts, an additional surcharge will be charged to the Customer(s) 8.95 euros. The sum of the length, width and height CANNOT exceed 2 meters which I have never encountered based on my Product offerings
Insurance Coverage. There is a standard automatic indemnity included in all shipping purchases. With no insurance taken, the indemnity is 23 euros per kilogram plus the shipping cost, up to a maximum of 690 euros. If the value of your order is above €200, you can also take out additional insurance cover (Ad Valorem), but with a limit on the maximum amount, depending on the destination. If extra insurance if desired, please let me know in advance and I can give you a price quote by destination so if you decide to take it, I can add it into your final order invoice.
If you shipment is lost or damaged during transit, then you must submit a claim within 23 days of the date of the shipping. Claims for late deliveries are no longer supported by the Shipping Carriers. For more detail, please also refer to section - Quality & Compliance Issues- Processing Damages
Mondial Relay – Point Relay Delivery Pick up Location/Limited Home Delivery:
(ONLY offered in France, Belgium, Luxembourg, Netherlands, Spain & Portugal) & Domicile Home Delivery (ONLY Germany, Luxembourg, Netherlands, Spain, Portugal, Austria and Italy).
The sum of the length, width or height of the package CANNOT exceed 1.50 meters and the length less than 1 meter. Maximum weight of 20 kgs per shipment parcel.
This is a low-cost shipping option therefore low-cost customer service and handling. I offer it as I know I package my orders carefully enough to reduce the risk of breakage during transit but there is still a risk of loss if orders are damaged.
With no insurance is taken, there is a standard automatic indemnity for loss and damages of 25 euros but additional insurance can be purchased by you upon request. You must let me know in advance so I can add the cost it to the final order invoice. Please note: If no insurance coverage taken, the compensation for lost or damages is limited to the 25 euros in total per 1 order as long as you submit the required paperwork within the guidelines of the terms of services of Mondial Relay.

The package will be delivered to a « pick up location of your choice « and/or home delivery against signature, where offered. You will need specify in the notes of the order the preferred location for the delivery of your order.

4. Happy-Post - Point Relay Delivery Pick up Location/Limited Home Delivery
This is another low-cost shipping option for shipments originating from France. They ship worldwide under a larger corporate contract where the cost of shipment is based on the volumetric weight of your package in cm (length x width x height)/5000 = weight in KG. If the package is larger in volume, it could inflate the cost of your package whereas with Colissimo and Mondial Relay volumetric weight is not used (based on my contract with them).
Example: A package with a weight of 5 kilos but the length 35 cm x width 35 cm x height 35cm = 8,57 KG volumetric weight. There is no tariff list as it depends on the dimensions of the final package (which I can estimate if given a precise list of products in the order).

If no insurance is taken, there is a standard automatic indemnity for loss and damages as follows:
- National (EU): €12 per kg with a maximum of €180 per shipment.
- International (Outside of EU): €23 per kg with a maximum of €345 per shipment.
Example: Delivery of shipment in Belgium for a 5 kg shipment (order value €200). If there is damaged or loss of shipment, the maximum indemnity is €60 (5 kg x €12) as long as all the requirements for processing the claim are met in accordance with Happy-Post Terms of Sale. The damages suffered by you will be €140 in this instance without additional insurance.
In the event that the shipment is not delivered, you have 15 days from the maximum delivery date provided, to send Happy-Post a registered letter for the reason of “No Delivery”.
In the event of damage to the integrity of the shipment, you have 48 hours after delivery date to send Happy-Post a registered letter on the grounds of “Material damage/Missing Parcel”.

Dispatch & Delivery Confirmation
Once the order is fulfilled and dispatched to the Shipping Carrier, I will send a shipping confirmation with tracking by email to you and then another email once the Products have been delivered.
The Products will be delivered to the address given by you in the Order Confirmation. If the package is considered “undeliverable” by the Shipping Carrier or there is an issue with the Customs/Duties, I am NOT responsible for any cost or loss incurred associated with additional charges incurred or re-delivery of a shipment.
Furthermore, for shipments requiring signature, and you are not available (absent) at the time of the first attempt of delivery, you are responsible to collect the package from local post office within 10 days from date of first attempt. At times, the Shipping Carrier may leave a Delivery Notice in the mailbox but this service is NOT guaranteed especially if outside of France. As stated above, the tracking is sent by email upon dispatch of the order, you MUST monitor this tracking status to ensure they collect the package before the end of this 10-day period. If the package is “returned to sender” by the post office, I am NOT responsible for any re-delivery charges nor will I refund the original shipping cost if you chose to canceled your order.
If the parcel is being sent outside of the European Union, then I will complete a customs declaration CN23. Please let me know if there is special information you want me to include on this declaration to make it more clear to your countries border control agents and faster processing.
Quality & Compliance Issues- Processing Damages
In the event of delivery of the Product(s) that does not correspond to the order (defective or non-compliant) or you change your mind, you must send “Return Compliant Request” by email to frenchvintagetresors@gmail.com within 48 hours from the date of receipt of the package (except for in the case of RIGHT OF WITHDRAWAL in Section 7 of the Terms of Sale).
This request must include: Your details (invoice, Product references, reasons for the complaint – references in the Item Descriptions that doesn’t correspond with what you received. The return of Products must be made within seven working days from the assignment of an approved returns number by the me.
If an error is determined by me in the description of the Product, we will decide together how to handle the return, depending on the return shipping cost.
If there was no error in the description in English and/or photos, you are responsible for the cost of the returned shipping cost. Please read of the item descriptions in English carefully and review the photos and collages using ZOOM to make sure you fully understand the condition of these used Products. Please ask me if you are unsure. As I always want happy Customer, I am willing to work with Customers to you to reach an amicable compromise where possible.
If you chose to return the Product order (14-day retraction period), you are responsible for the cost of shipping (original order shipping cost and the return shipping). All Product items MUST be in the original condition (not altered) packaging and include all of the Product and its accessories. Any risk associated during the period of the returning the Product is the responsibility of you. The Product cost will be refunded upon inspection of the items return at my discretion. Refer to Section 7 of the Terms of Sale.
Inspection Guidelines at the time of delivery of the Products
You MUST inspect with the Shipping Carrier or pick up location if Mondial Relay or at your local post office for pickup as follows:
- Inspect the package to ensure the packaging is seal and intact, not damaged with holes or dents or wet or altered in any way. If possible, this should be done before signing acceptance of the package while the Shipping Carrier is still present or while still at the pick-up location. Please note: For Mondial Relay, as soon as the package is collected and leaves their premises, there is a transfer of responsibility and they can no longer be held responsible for damages. It’s better if you open the package on and inspect the….
- If no visible damage, sign the delivery receipt and open the package to ensure the number of items delivered corresponds to what is indicated on the invoice or order details form;
Submitting a Shipping Claim (Reclamation):
As stated above, if the shipment is damaged or lost during transport, a shipping claim MUST be processed under the following conditions.
PLEASE NOTE: FOR ALL INTERNATIONAL SHIPMENTS, the Customer MUST 1st file a claim with the local Shipping Carrier who delivered your order to your address or local post office where you picked up your order (i.e., USPS, Japan Post, China Post, Canada Post, Australia Post, Swiss Post, Royal Mail, etc.). There will always be 2 tracking numbers issued for international orders, the one that I provide you from French provider and once it transfers to your country of local tracking number is assigned by your local postal service (the local DPE). When processing claims, there is a partnership agreement and cost sharing of the damages so there must be a claim processed by both providers in order to issue the reimbursement.
You MUST provide the following to me in order for me to assist in the processing of your Shipping Claim (Reclamation):
- Completed International Claim Form processed in your country with the local Shipping Carrier – International Only
- Invoice number and order references
- And, if damaged, the following documentation is required to processing the claim with the Shipping Carrier and it’s International partners:
- Description of the damage to the Products and/or the packaging. If there was no visible damage to the box, please specify as they will ask why you didn’t refuse the package.
- Photograph of the shipping label on the packages with the tracking number clearly visible
- Photograph of the damaged items next to the box showing the Shipping Label and any damages to the box during transit.
- Photograph of the shipment packaging (inside the box) and packaging materials
- Photograph of all the damaged items
These photos with the copy of the completed reclamation/claim form must be sent by Email to frenchvintagetresors@gmail.com within 48 hours of delivery receipt date of the package.
It can take up to 90-180 business days to resolve a shipping claim. VIVE LA FRANCE.
Packaging Materials:
To be economically responsible and avoid handling fees, where possible, I will use recycled materials for packaging while being mindful to use suitable materials to ensure the safest expedition and protection of your order during the transport by the Shipping Carrier. I pack very carefully especially fragile times and checks to make sure the most cost-efficient method is available to Customer(s).
Section 7: RIGHT OF WITHDRAWAL & RETURN POLICY
In accordance with Section L.121-21 of the Consumer Code as described below, you have the right to withdraw from our contract an exercise without reason within 14 (fourteen) days from the date on which the you take possession of the Product(s and, in the event of partial delivery, of the last Product.
In order to exercise your right of withdrawal, you must, within the period mentioned above, send by email or post:
- the request for withdrawal form (Customer's contact details, invoice, Product references, references in the Item Descriptions that doesn’t correspond with you’re the duct. The return of Products must be made within seven working days from the assignment of an approved returns number by the me.
, duly completed and signed; or
- a communication of its intention to exercise its right of withdrawal in accordance with Section L121-21 of the Consumer Code; such communication must include the following information: (i) the indication of the Product for which the Customer wishes to exercise his right of withdrawal; (ii) order number; and (iii) in the event that the Customer purchases the Product by bank transfer, the IBAN code of the Customer to which the reimbursement can be made;

You have another 14 (fourteen) days from the date of notice of withdrawal to return the items to me. Beyond this timeframe, I reserve the right to refuse the return as the legal terms have not been respected, thus being a time lapse of the right of withdrawal.
The shipping costs and any cost incurred relating to the return of the Product(s) are the FULL responsibility of you. The Products MUST be returned in their original condition, unaltered, unused, undamaged, and with their original labels attached to the Products. In the event of a reduction in the value of the Products resulting from the handling of the goods by you going beyond what is necessary to establish the nature, characteristics and functioning of the goods, I reserve the right to refuse the return of the Product(s). You are solely responsible for any reduction in value of the Products resulting from handling of the goods going beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Once validated, I will reimburse the purchase price of the Product received, excluding any delivery costs or any other fees incurred related to the return, within 14 days after receiving the returned Product(s), or after you provide proof of return of the returned Products. The transfer of ownership of my products and the correlative transfer of the risks of loss and deterioration relating thereto, will be carried out upon Order Fulfillment date when the package is handed over to the Shipping Carrier, materializing the agreement of the parties on the thing and on the price and this regardless of the date of payment and delivery.
The products therefore travel at the risk by you who may, in the event of damage, make any claims to the carrier under the legal and regulatory conditions in force.
Consequently, you are informed of the importance of checking the products upon delivery and of not accepting any product which appears to be damaged or having been previously opened, at the risk of no longer being able to exercise any recourse against the carrier.
I take the greatest care in preparing your order and packaging the products purchased. However, at times the Shipping Carrier, unfortunately, does not always use the same gentle care of the packages entrusted to them.
